    3. What information do we collect?

    We collect personal information that you voluntarily provide to us when you register on the Services, express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.

    Personal Information Provided by You. The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make, and the products and features you use. The personal information we collect may include the following:

    We do not process sensitive information.

    We may provide you with the option to register with us using your existing social media account details, like your Google or other social media account.     All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

    We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.

    Like many businesses, we also collect information through cookies and similar technologies.

    The information we collect includes:

    • Log and Usage Data. Log and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type, and settings and information about your activity in the Services (such as the date/time stamps associated with your usage, pages and files viewed, searches, and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called “crash dumps”), and hardware settings).

How much information we collect depends on the type and settings of the device you use to access the Services. For example, we may use GPS and other technologies to collect geolocation data that tells us your current location (based on your IP address). You can opt out of allowing us to collect this information either by refusing access to the information or by disabling your Location setting on your device. However, if you choose to opt out, you may not be able to use certain aspects of the Services.

     

    4. How do we process your information?

    We process your personal information for a variety of reasons, depending on how you interact with our Services, including:

    • To facilitate account creation and authentication and otherwise manage user accounts. We may process your information so you can create and log in to your account, as well as keep your account in working order.
    • To deliver and facilitate delivery of services to the user. We may process your information to provide you with the requested service.
    • To respond to user inquiries/offer support to users. We may process your information to respond to your inquiries and solve any potential issues you might have with the requested service.
    • To send administrative information to you. We may process your information to send you details about our products and services, changes to our terms and policies, and other similar information.
    • To save or protect an individual’s vital interest. We may process your information when necessary to save or protect an individual’s vital interest, such as to prevent harm.

    5. What legal bases do we rely on to process your information?

    Article 6 I lit. a DS-GVO serves our company as the legal basis for processing operations in which we obtain consent for a specific processing purpose. If the processing of personal data is necessary for the performance of a contract to which the responsible person is a party, as is the case, for example, with processing operations that are necessary for the delivery of goods or the provision of another service or consideration, the processing is based on Article 6 I lit. b DS-GVO. The same applies to such processing operations that are necessary for the implementation of pre-contractual measures, for example in cases of inquiries about our products or services. If our company is subject to a legal obligation by which a processing of personal data becomes necessary, such as for the fulfillment of tax obligations, the processing is based on Art. 6 I lit. c DS-GVO. In rare cases, the processing of personal data might become necessary to protect vital interests of the responsible person or another natural person. This would be the case, for example, if a visitor were to be injured on our premises and as a result his or her name, age, health insurance data or other vital information had to be passed on to a doctor, hospital or other third party. Then the processing would be based on Art. 6 I lit. d DS-GVO. Finally, processing operations could be based on Art. 6 I lit. f DS-GVO. Processing operations that are not covered by any of the aforementioned legal bases are based on this legal basis if the processing is necessary to protect a legitimate interest of our company or a third party, provided that the interests, fundamental rights and freedoms of the responsible person are not overridden. Such processing operations are permitted to us in particular because they were specifically mentioned by the European legislator. In this respect, it took the view that a legitimate interest could be assumed if the responsible person is a customer of the controller (recital 47 sentence 2 DS-GVO).

    6. When and with whom do we share your personal information?

    We may need to share your personal information in the following situations:

    • Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

     

    7. How do we handle your social logins?

    Our Services offer you the ability to register and log in using your third-party social media account details (like your Google login). Where you choose to do this, we will receive certain profile information about you from your social media provider. The profile information we receive may vary depending on the social media provider concerned, but will often include your name, email address, and profile picture, as well as other information you choose to make public on such a social media platform.

    We will use the information we receive only for the purposes that are described in this privacy notice or that are otherwise made clear to you on the relevant Services. Please note that we do not control, and are not responsible for, other uses of your personal information by your third-party social media provider. We recommend that you review their privacy notice to understand how they collect, use, and share your personal information, and how you can set your privacy preferences on their sites and apps.

    8. How long do we keep your information?

    We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). No purpose in this notice will require us keeping your personal information for longer than the period of time in which users have an account with us.

     

    When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

    9. Do we collect information from minors?

    We do not knowingly solicit data from or market to children under 18 years of age. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Services. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records.     8. What are your privacy rights?

    In some regions (like the EEA and UK), you have certain rights under applicable data protection laws. These may include the right (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; and (iv) if applicable, to data portability. In certain circumstances, you may also have the right to object to the processing of your personal information. You can make such a request by contacting us by using the contact details provided in the section “How can you contact us about this notice?” below.

    We will consider and act upon any request in accordance with applicable data protection laws.

    If you are located in the EEA or UK and you believe we are unlawfully processing your personal information, you also have the right to complain to your Member State data protection authority or UK data protection authority.

    If you are located in Switzerland, you may contact the Federal Data Protection and Information Commissioner.

    Withdrawing your consent: If we are relying on your consent to process your personal information, you have the right to withdraw your consent at any time. You can withdraw your consent at any time by contacting us by using the contact details provided in the section “How can you contact us about this notice?” below.

    However, please note that this will not affect the lawfulness of the processing before its withdrawal nor will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

    Opting out of marketing and promotional communications: You can unsubscribe from our marketing and promotional communications at any time by clicking on the unsubscribe link in the emails that we send, or by contacting us using the details provided in the section “How can you contact us about this notice?” below. You will then be removed from the marketing lists. However, we may still communicate with you — for example, to send you service-related messages that are necessary for the administration and use of your account, to respond to service requests, or for other non-marketing purposes.

    If you would at any time like to review or change the information in your account or terminate your account, you can:

      Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our legal terms and/or comply with applicable legal requirements.

      Cookies and similar technologies: Most Web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or services of our Services. You may also opt out of interest-based advertising by advertisers on our Services.

      9. Do we use cookies?

      The internet pages of acehub.io use cookies. Cookies are text files that are placed and stored on a computer system via an Internet browser. Numerous Internet pages and servers use cookies. Many cookies contain a so-called cookie ID. A cookie ID is a unique identifier of the cookie. It consists of a string of characters by which Internet pages and servers can be assigned to the specific Internet browser in which the cookie was stored. This enables the visited Internet pages and servers to distinguish the individual browser of the responsible person from other Internet browsers that contain other cookies. A specific internet browser can be recognized and identified via the unique cookie ID.

      Through the use of cookies, acehub can provide the users of this website with more user-friendly services that would not be possible without the cookie setting.

      By means of a cookie, the information and offers on our website can be optimized in terms of the user. Cookies allow us, as already mentioned, to recognize the users of our website. The purpose of this recognition is to make it easier for users to use our website. For example, the user of a website that uses cookies does not have to re-enter his or her access data each time he or she visits the website, because this is handled by the website and the cookie stored on the user’s computer system. Another example is the cookie of a shopping cart in an online store. The online store remembers the items that a customer has placed in the virtual shopping cart via a cookie.

      The responsible person can prevent the setting of cookies by our website at any time by means of an appropriate setting of the Internet browser used and thus permanently object to the setting of cookies. Furthermore, cookies that have already been set can be deleted at any time via an Internet browser or other software programs. This is possible in all common Internet browsers.       10. Provision of website and creation of log files

      Each time our website is accessed, our system automatically collects data and relevant information from the computer system of the calling device. 

      The following data is collected:

      • Browser type and version used
      • The user’s operating system
      • The user’s internet service provider
      • The IP address of the user
      • Date and time of access
      • Web pages from which the user’s system accessed our website
      • Web pages accessed by the user’s system through our website

      This data is stored in the log files of our system.

      The temporary storage of the IP address by the system is necessary for the delivery of the website to the computer of the user. For this purpose, the user’s IP address must be kept for the duration of the session.

      The storage in logfiles is done to ensure the functionality of the website. The data is also used to optimize the website and to ensure the security of our IT systems. An analysis of the data for marketing purposes does not take place.

      For the aforementioned purposes, our legitimate interest lies in the processing of data in compliance with Art. 6 (1) 1 (f) GDPR.

      The legal basis for the temporary storage of data and logfiles is Art. 6 (1) (1) (f) GDPR.

      The data will be deleted as soon as it is no longer necessary for the purpose of its collection. The session is complete when the collection of data for the provision of the website is accomplished.

      If the data is stored in log files, this is the case after seven days at the latest. Storage beyond this is possible. In this case, the IP addresses of the users are deleted or alienated so that an assignment of the calling client is not possible.

      The collection of data for the provision of the website as well as the storage of data in log files are essential for the operation of the website. Therefore, the user may not object to the aforementioned processes.

      11. Contact via Email

      You can contact us via the email address provided on our website. In this case the personal data of the user transmitted with the email will be stored. The data will be used exclusively for the processing of the conversation.

      If you contact us via email, this also constitutes the necessary legitimate interest in the processing of the data.

      If the user has given consent, the legal basis for processing the data is Art. 6 (1)(a) GDPR.

      The legal basis for the processing of data transmitted while sending an email is Art. 6 (1) (1) (f) GDPR. If the purpose of the email contact is to conclude a contract, the additional legal basis for the processing is Art. 6 (1) (b) GDPR.

      The data will be deleted as soon as it is no longer necessary to achieve the purpose for which it was collected. For personal data sent by email, this is the case when the respective conversation with the user has ended. The conversation ends when it can be concluded from the circumstances that the matter in question has been conclusively resolved. The additional personal data collected during the sending process will be deleted after a period of seven days at the latest.

      The user has the possibility to withdraw consent to the processing of their personal data at any time. If the user contacts us by email, he can object to the storage of his personal data at any time. In this case, all personal data stored while establishing contact will be deleted.

      12. Contact form

      A Contact form is available on our website, which can be used for electronic contact. If a user makes use of this option, the data entered in the input mask will be transmitted to us and stored.

      When sending the message the following data will also be stored:

      • Email address
      • Last name
      • First name
      • Telephone / mobile phone number
      • IP address of the user’s device
      • Date and time of contact
      • Company Name

      As part of the sending process, your consent will be obtained for the processing of your data and reference will be made to this privacy policy.

      Alternatively, you can contact us via the email address provided. In this case the personal data of the user transmitted with the email will be stored.

      The data will be used exclusively for the processing of the conversation.

      The processing of the personal data from the input mask serves us exclusively for the purpose of establishing contact. If you contact us by email, this also constitutes our necessary legitimate interest in the processing of the data.

      The other personal data processed during the sending process serve to prevent misuse of the Contact form and to ensure the security of our information technology systems.

      The legal basis for the processing of the data is Art. 6 (1) (1) (a) GDPR if the user has given his consent. The legal basis for the processing of data transmitted while sending an email is Art. 6 (1) (1) (f) GDPR. If the purpose of the email contact is to conclude a contract, the additional legal basis for the processing is Art. 6 (1) (1) (b) GDPR.

      The data will be deleted as soon as they are no longer necessary to achieve the purpose for which they were collected. For the personal data from the input mask of the Contact form and those sent by email, this is the case when the respective conversation with the user has ended. The conversation ends when it can be inferred from the circumstances that the facts in question have been conclusively clarified. The additional personal data collected during the sending process will be deleted after a period of seven days at the latest.

      The user has the possibility to withdraw the consent to the processing of their personal data at any time. If the user contacts us by email, he can object to the storage of his personal data at any time. In this case, all personal data stored while establishing contact will be deleted.

      13. Use of Mailchimp

      We use Mailchimp from The Rocket Science Group, LLC, 675 Ponce de Leon Ave NE Suite 5000, Atlanta, GA 30308 USA (Mailchimp) to send our newsletter. This allows us to contact subscribers directly. In addition, we analyze your usage behavior in order to optimize our offer. For this purpose, we share the following personal data with Mailchimp:

      • Email address
      • First name
      • Last name

      Mailchimp is a recipient of your personal data and acts as a processor for us as far as the sending of our newsletter is concerned. The processing of the data provided under this section is not required by law or contract. Without your consent and the transmission of your personal data, we cannot send out a newsletter to you.

      In addition, Mailchimp collects the following personal data using cookies and other tracking methods: Information about your terminal device (IP address, device information, operating system, browser ID, information about the application you use to read your emails and other information about hardware and internet connection. In addition, usage data is collected such as date and time, when you opened the email / campaign and browser activity (e.g. which emails / web pages were opened). Mailchimp needs this data to ensure the security and reliability of the systems, compliance with the terms of use and the prevention of abuse. This corresponds to the legitimate interest of Mailchimp (according to Art. 6 para. 1 lit. f DSGVO) and serves the execution of the contract (according to Art. 6 para. 1 lit. b DSGVO). 

      Furthermore, Mailchimp evaluates performance data, such as the delivery statistics of emails and other communication data. This information is used to create usage and performance statistics of the services.

      Mailchimp additionally collects information about you from other sources. In an unspecified period and scope, personal data is collected via social media and other third-party data providers. We have no control over this process.

      The legal basis for these processing operations is your consent pursuant to Art. 6 (1) lit. a DSGVO. You can revoke your consent to the processing of your personal data at any time. A corresponding link can be found in all mailings. In addition, the revocation can be made via the specified contact options. By declaring the revocation, the lawfulness of the processing carried out so far is not affected.

      Your data will be processed as long as a corresponding consent is available. Apart from this, they will be deleted after the termination of the contract between us and Mailchimp, unless legal requirements make further storage necessary.

      Mailchimp has implemented compliance measures for international data transfers. These apply to all global activities where Mailchimp processes personal data of individuals in the EU.       We at acehub use Mixpanel to collect and process personal data in compliance with the General Data Protection Regulation (GDPR) and other applicable privacy laws. This statement explains how we use Mixpanel and how it affects your privacy.

      Mixpanel is a tool that helps us collect and process data about our users. This data is used to improve our products and services, as well as to personalize our communications with you.

      16. Use of Google Analytics

      We use Google Analytics, a web analysis service provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA and its representative in the Union Google Ireland Ltd., Gordon House, Barrow Street, D04 E5W5, Dublin, Ireland (Hereinafter referred to as Google). Google Analytics examines, among other things, the origin of visitors, their length of stay on individual pages and the use of search engines, thus allowing better monitoring of the success of advertising campaigns. Google places a cookie on your computer. This allows personal data to be stored and evaluated, in particular the user’s activity (in particular which pages have been visited and which elements have been clicked on), device and browser information (in particular the IP address and the operating system), data on the advertisements displayed (in particular which advertisements have been displayed and whether the user has clicked on them) and also data on advertising partners (in particular pseudonymised user IDs). The information generated by the cookie about your use of this website will be transmitted to and stored by Google on servers in the United States. However, if IP anonymization is enabled on this online presence, Google will previously truncate your IP address within member states of the European Union or other signatory states to the Agreement on the European Economic Area.       The purpose of processing personal data is to specifically address a target group that has already expressed an initial interest by visiting the site.

      The legal basis for the processing of personal data is the user’s given consent in accordance with Art. 6 (1) (1) (a) GDPR.

      Your personal information will be stored for as long as is necessary to fulfill the purposes described in this Privacy Policy or as required by law. Advertising data in server logs is anonymized by Google’s own statements to delete parts of the IP address and cookie information after 9 and 18 months respectively. 

      You have the right to revoke your declaration of consent under data protection law at any time. The revocation of the consent does not affect the lawfulness of the processing carried out on the basis of the consent up to the revocation.

      You may prevent the collection and processing of your personal data by Google by preventing the storage of cookies by third parties on your computer, by using the “Do Not Track” function of a supporting browser, by deactivating the execution of script code in your browser or by installing a script blocker such as NoScript (https://noscript.net/) or Ghostery (https://www.ghostery.com) in your browser. your IP address) to Google and to prevent the processing of this data by Google by downloading and installing the browser plug-in available under the following link: https://tools.google.com/dlpage/gaoptout?hl=en

      What is Tidio?

      Tidio is a tool that allows us to communicate with our website visitors through live chat and chatbots. Tidio collects and processes data to provide us with chat functionalities on our website.

      What data do we collect?

      We collect personal data that you provide to us directly, as well as data that we collect automatically when you use our website or services. This might include your name, email address, IP address, and browsing history.
